The parties went through a marriage ceremony or a purported marriage ceremony at a Coptic Orthodox Church knowing that it was not licensed to carry out marriages under the Marriage Act 1949. Although this fact would not have made the marriage void they also knew that the priest was not licensed to conduct the ceremony and that notice of marriage had not been given to the superintendent registrar. The priest had advised the coupe that a civil ceremony should take place but they did not do this so the marriage was void.

Prior to the Act this was not the case. The Civil Partnership Act 2004 has also given a quasi-spousal and familial status to same sex couples who register their partnerships. The Marriage Act 2013 has also compounded these rights. (see Chapter two for details of the Act). The law has moved on significantly, as can be seen. However, there are categories of excluded relationships that need further discussion. Excluded relationships There are two categories of relationship, which although functionally familial, have only been granted limited legal rights.

One of the spouses, referred to as the petitioner will fill in a set of forms and sign an affidavit confirming the truth of the petition. These will be inspected by a district judge who, if satisfied that all is in order will issue a certificate and a divorce decree will be granted. Contested petitions Very few petitions are contested, less than 3%, but if one is contested then there will be a full hearing in front of a judge. A decree of divorce will only be refused when the respondent is able to prove that the petitioners factual statement is incorrect and that the marriage remains viable.
